What do we do with your information?

Information collected by us

When carrying out legal services, we collect the following personal information that you provide to us:

  • Your name and address as well as telephone number
  • Any former names or addresses used by you
  • Information about your identity such as passport details or date of birth
  • Your signature
  • Information in respect of the matter you require our legal services for
  • Financial information in respect of you to include source of funds and source of wealth

We collect the following information from other sources:

  • Electronic identity verifying companies
  • Estate agents
  • Sanctions screening providers
  • Your bank or building society for information related to your accounts
  • Your mortgage lender
  • Your mortgage broker

How we use your personal information

We use your personal information for the following purposes:

  • To carry out the legal services you have engaged us to complete
  • To comply with regulations

Whether information has to be provided by you, and why?

The personal information referred to above must be provided by you to us, to enable us to carry out the legal services you instruct us to complete. When we collect information from you, we will inform you whether you are required to provide this information to us.

Legal reasons we collect and use your personal information

We rely on the need to carry out the legal services we are instructed to complete, compliance with regulations and our legitimate interests as the legal basis for processing your information.  Our legitimate interest is our business or commercial reason to utilise your information but this will not affect your rights under data protection laws.

Who will we share your personal information with?

We have relationships with a number of third parties that we routinely share personal data with. These third parties include search providers, estate agents and solicitors representing the other parties on transactions we are dealing with for you. This data sharing enables us to progress the work we are carrying out for you.

We will share personal information with law enforcement agencies if required by applicable law.

We will not share your personal information with any other third parties without your consent.

Transfer of your information to countries within the European Economic Area (EEA)

It may be necessary to transfer your personal information to countries within the EEA. These countries are subject to the General Data Protection Regulation (GDPR) which provides effectively identical data protection as the UK GDPR.

Transfer of your information to countries that are outside the EEA

It may be necessary to transfer your personal information to countries that are outside of the EEA or to an international organisation in order to carry out the work you have instructed us to complete.

These non-EEA countries have been deemed by the European Commission to offer adequate protection of personal data. Any transfer will be subject to the international data transfer agreement or the international data transfer addendum to the European Commission’s standard contractual clauses for international data transfer as permitted under section 119A of the DPA 2018. These safeguards are designed to protect your privacy rights and provide you with remedies in the unlikely event that your personal information is misused.

Where will we store your personal data and how long for?

The information is securely stored in accordance with our firm’s Retention Policy available on request.

We keep personal information for a period in accordance with our firm’s Retention Policy. At the end of the retention period we will then securely dispose of your information.

Consent

We are relying on your explicit consent to processing your data. You provided this consent when you instructed us to act on your behalf.

You have the right to withdraw this consent at any time, but this will not affect the lawfulness of any processing activity we have carried out prior to you withdrawing your consent. You can opt-out by emailing our Data Protection Officer.

Under the UK GDPR, you have a number of important rights that you can exercise free of charge. In summary, these rights are:

  • Access to your personal information and other supplementary information;
  • Rectification – require us to correct any mistakes or complete missing information we hold on you;
  • Erasure – require us to erase your personal information in certain circumstances;
  • Receive a copy of the personal information you have provided to us or have this information be sent to a third party, this will be provided to you or the third party in a structured, commonly used and machine readable format;
  • Object at any time to processing of your personal information for direct marketing;
  • Object in certain other situations to the continued processing of your personal information;
  • Restriction – request that we restrict our processing of your personal information in certain circumstances;
  • Data portability – ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.
  • Request not to be subject to automated decision making which produce legal effects that concern you or affect you in a significantly similar way.

Our security

We have controls in place to ensure that your information is kept secure. Such controls include access controls so that your data is only accessed for our business need to deliver the service you require us to complete. We also control the processing, storing and erasure of your information in a secure way.

Future processing

We do not intend to process your personal information for any reason other than stated within this privacy notice. If this changes, we will inform you by writing to you.
